SHARE OF COMMON ELEMENTS, COMMON
SURPLUS, COMMON EXPENSE, ANL~ VOTE
Each Unit Owner owns, in aadition to his unit or apartment, an
interest in the common elements of the property. The common elements
include qenera.l common eiements for the use of all Unit Owners and
certa.in limited common elements which are includeci wittiin the common
elements insofar as ownership is concerned, but whose use is res-
tricted to one or more Unit Owners.
Each condomiruum parcel consists of the unit or apartment and
an unciivided 1/4th interest in the common elenpents, common surplus.
. and common expenses. Each Unit Owner of an entire condominium
parcel owns a 1/4th undivided interest in the common elements
, and common surplus and is likewise liable for a 1/4th share in the
. ~ common expenses.
Each interval owner shall have the entire use and ownership of
the 1/4th undivicied interest in the common elements appurtenant to
his unit (collectively, the condominium parcel) during the perioa of ~ ~
each of his Unit Weeks for the period of the esta.te for years. Luring
the ~eriod of the esta.te, each such esta.te shall be reoccurring and
followed in succession by the other esta.tes of the other Interval
Owners for sta.ted periods of time consisting of the Unit Weeks
belonging to the other Interval Owne-rs. In aduition, each Interval
Qwner a~so owns a 1/208th undiviciea interest in remainder in fee
simple in the common elements for each Unit Wesk owned which ~
shall likewise, at all times, be equal to~ his fra.ctional share in the
common surplus. He sha.ll likewise be responsible for a 1/208th
' share in the common expenses at all times for each Unit Week con-
E ta,ined within his Interval Ownership. Therefore, each Interva.l
~ Owner's remainaer interest in the common elements ana share in the
~ common surplus and common expenses sha.ll be equa.l to 1/2JStk~
iimes .the number of Unit Weeks con;ained within his Interval Ownership.
In addition, each Unit Owner sha.ll be entitled to a certain vote
in the total votes of all Unit Owners in the condominium owners'
association (Turtle Reef Condominiums II, Inc. whlch vote is
appurtena.nt to this unit. ~ Each Interval Owner in a parcel committed
to Interval Ownership sha.ll be entitled to one vote for each Unit Week _
conta.ined withirr his Interval Ownership (i. e. , each Interval Ow-ner
shall have the number of votes equal to one (1) times the number of
Unit `~hleeks conta.ined within his Interval Ownership).
