Further, the Mar~agement Firm does hereby accept such agency, authority and employment for all purposes and in all matters herein described. ~ T:~ RM A NL` 4. The term of this Agreement shall be from the date of the NEV~'AL execution of this Agreement (which is set forth on the iirst Pa.ge of this Agreement) and shall continue from this tlme through and until June 30;1987.. ~ Thereafter, it shall be automatically renewed for successive per:ods of five (5) years unless and until terminated by a vote of 75~ of all those who are then votinq members of the Association at a duly authorized meeting of the Association or by the IVlanagement Firrn giving written notice to the Loard at least sixty (EO) days prior to the time of the renewal of th~is Agreement . that the Agreement will not be renewed for the next successive five,year period. Nothing herein sha.ll contravene the management contract termina tion provisions of the Condominium A ct. V~'here this document is in conflict with the Condominium Act, the provisi~ns of the C~nd~minium Act shall preva il. ~ `,~'ERS CF 5. The Management Firm is hereby irrevocably granted for the T~~ ~ period of this Agreement and all su~cessive and renewal terms hereof, and '.-=~~NAGER while this Agreement ~hall remain in.effect, to the exclusion af all other persons, firms ~r corporations (including, but not limited t~, tne Assoe- iation, its F~ard and its members) a11 powers and duties ~f the Ass~cia.ti~n and it s L~oard of Administration as set forth in the L~eclaration and the Exhibits (except 3nd excludinq, ~however, those powers and duties as are specifically rec:juired to be exercised by the Eoard of Administration or the members of the Association in said L`eclaration and Exhibits). L~y way of illustra.tion a~nd n~t of limitation, the N'anagement Firm shall have the sole ~ power or authority and riqht to: i T_ ~~STRA- ta) Hire, pay and supervise or cause to be hired, p3id and ~ .~:~NS CF supervised, all persons; firms, corporations ~r associations necessary to ! ^;~~,rE be employed in order to properly_mainta,in and operate Turtle Reef Condo- i ~ ~~`:~~FI^ miniums II includinq one or more Resident Managers (who in su~h instarce ~ ~~,~'~RS shall be an employee or employees of the Manaqement Firm) and the L~II_ Mana.gement Firm, in its absolute discretion, shall determine the number or T~CNS numbers of employee(s) to be so employed and in its absolute discretion, ~ any employee or employees to be disc'narged for any reaGon whatsoever. (b) To maintain and repair the property of Turtle Reef Condo- ~ minium II and the comm~n elements thereof to the same extent that the A ssociation is required to maintain and re~ir the same, as provided in the reclaration.. For any one item of repair, replacement or rpfurbishing, the ' expense,incurred to the Associa.tion a~ a whole, shall not exceed Three Thousand ($3, 000.00) L~ollars unless specifically authorized by the L~ard ~f ~ Adminfstrati~n of the Association, except as otherwise herein provided, ~r in the case of emerqency, in which case the Management Firm is authorized ~ to expend any sums necessary to prote~t and preserve the Ass~cia.ti~n and ~ its property. F~r improvement of, altera.tion to, ar addition to the common _ ~ elements ~r ? imited common elements, the Mana,gement Firm is hereby a~thorized to expend a maximum of Five Thousand ($5, 000.00) L'ollars. A ny amount in excess thereof, must be specifically authorized anc3 approved by the Loard of Administration of the Association. (c) To enter into contracts for qarbaqe and trash removal, vermin ~ W . R.
