~ J. To execute and deliver any written instruments
which my fiduciaries may deem advisable to~carry out any
power qranted to them. All persons shall be fully protected _
in relying upon.the power of my fiduciaries to execute every
such 3ngtrwaent and no one shall be obli.gated to see to the
applicat~ion by my fiduciaries of any money or property receiv.ed ;
by them pursuant tQ th~ execution and delivery of any such
instrument. '
K. To employ agents, accountants, auditors, attorneys
and real estate brokers, and to pay them reasonable compensa-
tion; ar~d to select an annual accountinq period.. .
L. It is not my intention that the assets of any
trust shall be conserved for the benefit of remaindermen. -
On the contrary, my primary purpo~se in creating all trusts
is to provide for the income beneficiaries. The_rights and . ~
interests of remaindermen are subordiriate and incidental .
to that purpose. Neither is it my intention to encourage
extravagance on the part of any beneficiary nor an aversion
to work on the pazt of any male beneficiary. ~Therefore, -
my ffduciaries, in exercising their discretion as to whether
to make distributions of the income or corpus of any trust
to.or for the benefit of any beneficiary for his or her ;
support, ec3ucation, health or maiatenance shall take into
consideration the standard of livinq to which such beneficiary
was accustame8 at the time of my death and all other income
and resources available to such beneficiary for such purposes
- from all sources known to my fiduciaries, together with any
other factors which my fiduciaries may deem pertinent.
M. T authorize my Executors to join with my wife `
in filinq any Federal income tax return for any year in which
~such joinder is permitted by law and to pay.all or such ratable
share:.of any taxes due thereon as my Executors shall deem -
groper,.and to consent to any qifts made by my-wife durinq
my lifetime as having been made one-half by me for the purpose
of any federal gift tax law. The exercise of such authority
by my Executors shall be final and conclusive~and not subject
- to questi~on by any person.
~ N. Whenever my fiduciaries shall have t~te right to 3
elect whether any item of expense connected with the admin- ~
istration of my estate or of any trust created herein shall
be claimed as a deduction for fed~ral incame tax_purposes
or whether the same shall be~claimed instead as a deduction
for federal estate tax purposes, I hereby authorize my fidu-
ciaries to exercise such right of election in such manner~
as they may, in their absolute discretion, determine to be
advisable, even thouqh the manner in which such election ~
is_exercised may result in an advantage or disadvantage to ~
any beneficiary hereunder as ca~apared with any other beneficiary ~
hereunder, and my fiduciaries shall not be required to make ~
any compensating adjustments in order to equalize the~effect
cf such election. .
