THIS CAUSE came on for trial before this Court on the 14th
day of June, 1978. The Plaintiff,-GRINER & GRINER, INC., ap-
- peared through counsel. The Defendant, COLUMBUS S. MADEWELL,
personally appeared and was represented by counsel. The
Defendants, ROBERT C. GOSS and SHIRLEY A. GOSS, his wife, did
not appear and were not represented by counsel. It was stip-
ulated that the case be submitted to -the.Court on the plead- -
ings for the determination of factual issues, and counsel
; presented legal argument on the issue of the Plaintiff's entitle-

` ~ ment to attorney's fees. Having considered the pleadings filed ;
~ r ers entered herein and~~the ar ument of counsel

& this Court finds and determines that the Defendant, COLUMBUS
S. MADEWELL, is•entitled to receive the interFlead funds; that ~
the Plaintiff claims an interest in said funds, which claim
constitutes an interest in said funds and in the outcome of

this litigation; that an interpleading party is.entitled to
receive attorney's fees only if said party is a totally dis-
f
inte.rested stakeholder and the Plaintiff is therefore not ;

~ entitled to~attorney's fees. This Court further finds and
~
~ determines that the Plaintiff is entitled to the taxable costs
~
~ of this action. It is thereupon , ~
