R E C I T A L S:
.WHEREAS, the parties were lawfully married to each other ~
at Prattville, Alabama. on September 3, 1942, and one of their
~ ~ . ~
children, JEAN ANN TUCKER, is still a minor and living with her '
mother, FRANCES B. TUCKER. one of the parties hereto; _ ~
WHEREA~, in contemplation of the filing of a Pe~tition and
~
Decree for Separation from Bed and Board~ the parties entered
into and executed a Property Settlement Agreement, which agreement
settled and adjusted the parties' rights~ obligations, duties,
claims and privileges-of all types and description arising out {
of their marital relationship, including provision for the pay- ~
ment of community debts, for the equal and equitable division ~
and partition of community and joint property, for spousal main-
f r su ort and education of~the arties' minor ~

daughter; - ~
WHEREAS, said Property Settlement Agreement was f~iled with
' the Pima County Superior Court along with the Petition for Sepa-
~ ration from Bed and Board on February 17, 1978;

WIiEREAS, the Petition for Separation from Bed and Board ~

filed with the Court was intended at all times by Che Parties to s
~ be a Petition for Legal Separation, and
WHEREAS, the Property Settlement Agreement f-iled ~aith the
CourC contained several blanks regarding descriptions of real ~
~ ~

property and identification numbers of some of the motor vehicles 3
~ ~
contained; ~ ~ ~
WHEREAS~, the parties wish to amend the Petition for Legal ~

~ Separation to Petition for Dissolution of Marriage, and wish to r~
~
~ obtain a Decree of Dissolution of Marriage from the Court rather °
~ - ~
~ than a Decree of Legal Separation;
~ ~ ~
~ ~ WHEREAS, in conjunction with s~id Petition and Decree for
