WHEREAS, Petitioners, SANDPIPER BAY, INC. and CAPRICORN HOLDING _
CO., INC., have ~resented the followinq:
1. Petitioners are the owners of Tract D, South Port~St. Lucie
Unit 9, a subdivision according to the Plat thereof as described in
Plat Book 14, Page 27, of the Public Records of St. Lucie County,
Florida. .
2. Respondent, CITY OF PORT ST. LUCIE, hereinafter called "CITY"

~ at all tiiaes mentioned herein, was and now is a municipal corporation, ~

~ of-the State of Florida.
~ 3. Respondent, RALPH LaCHAN~E, is the Building Official of the

E CITY and in such~capacity is responsible for the ministerial duty of

t issuing building permits within the municipal limits of such CITY. €
4. This is an action for Writ of Mandamus to compel the,issuance ~
of a building penait to SANDPiPER BAY, INC. and CAPRiCORN.HOLDING CO., ~

5, On June 9, 1978, Petitioners applied to Respondent, LaCHANCE,

as Building Official for the CITY , for the issuance of a buildinq permit

~ for the construction of ten retail stores on property located on

~ Morninqside Boulevard in said CITY and more particu3.arly described as
