with and satisfied the requirements of Paragraphs 5 and 6 of this ~
Court's Order rendered on April 25, 2978.
6. That-the Circuit Court of the Nineteenth Judicial Cir-
cuit in and For Saint Lucie County, Florida, on May 19, 1978, ren- ~
dered an Order Of Taking in the case of FLORIDA POWER & LIGHT COMPANY
-vs- FIRST NATIONAL BANK OF_FORT PIERCE AS PERSONAL REPRESENTATIVE ~
OF THE ESTATE OF PERRY CARLTON, DECEASED, Case No. 78-39 CA, awarding
possession of a 13.41 acre easement across Section 19 in Parcel C-4,
and that pursuant to the Order Of Taking, Florida Power & Light
Company was required and has.deposited the sum of $12,740,00 into the
registry of the Court.
7. That the "CALL FOR BIDS" approved by this Court and
this Court's Order of Apri1~25, 1978, required all written opening .
bids together with a ten percent.deposit of said bids to be snbmitted
to the Trust Department of the First Natianal Bank of Fort Pierce
on or before 9:34 A.M. o'clock on Monday, June 19, 1978.
8. That the First National~Bank as Personal Representative
has prepared a list of all pexsons who timel.y submitted written
opening bids and ten percent of same on or before 9:30 A.M. o'clock
on June 19, 1978. . -
~ 9. That other persons who did not comply with this Court's
Order and the "CALL FOR BIDS" have attempted to submit written -
opening bids with a ten percent deposit-after 9:30 A.M. o'clock.on ,
June 19, 1978. ' -
10. That none of the heirs who were personally present or
the Counsel of Record present representing the heirs of the Estate
;
nor any of the prospective bidders who were present registered any
objection on the record to any ruling.of this Court during the
Procedural Meetinq. '
