~I THIS CAUSE coming on to be heard upon the Plaintiff and
the Defendants` Joint Motion to Amend Final Judgment and the
~ Court after reviewing said Motion, as well as said Joint Settle-
~ ment Agreement filed herein and being otherwise fully advised in

~i the premises, it is thereupon
~ ORDERED AND ADJUDGED as follows:

This action came on for non-jury trial before the Court.

Prior to commencement of trial the Plaintiff took a voluntary

i; nonsuit as to all Defendants named in the complaint, excepting
~f
~ only the Defendants, JAMES ERSKINE and ?~IARGARET ERSKI~IE, his wife,
~
~ so that this Final Judgment is therefore applicahle to the
Plaintiff and the Defendants Erskine only.

The Plaintiff instituted and developed Outdoor Resorts at

; ~
~ Nettles Island, Inc., a recreational condominium concept develop-
~ 1 ment containing over. 1,500 camp sites serviced by water and ~
l~
~ electricity. The Declaration of Condominium was recorded by the
~ jj ;
~ Plaintiff developer on September 10, 1970 in the public records
i,
~ Ii
° of St. Lucie County, Florida. This original Declaration of
~ 'i i
~ ii Condominium contained a Paragraph Xi reading as follows, viz: ~
