marriage in any court having competent ~urisdiction~ for any '

cause now existing or which may hereafter arise, and no facts ~
' now Ianown to either the Husband or the Wife shall be deemed to
be merged in this Agreement to prevent such facts from being '
used in connection with any such action for dissolution of
marriage.
FOURTEENTH: In the event that any final judgment by a ~
court of competent jurisdiction shall be entered dissolving the.
marriage of the parties hereto, this Agreement shall be
incorporated in any such judgment. It is agreed, however, that ~
this Agreement shall in any case and at all times survive a~ty ~
~ such judgment and the terms and provisions hereof shall prevail
and obtain. The parties hereto expressly agree-that the terms
of this Agreement, including those which require the payment of
~ money may be enforced subsequent to the entry of a Final Judg- ~
~ ment Dissolution of Marriage by contempt proceedings and it ~
:
: shall not be necessary for the parties or either of them to
resort to a separate action for a breach of said term or terms.
. FIFTEENTH: The failure of either party to insist upon ~
strict performance of any provision of this Agreement shall not .
be deemed a waiver of the right thereafter to insist upon
~ performance of that or any other provision of this Agreement. `
. SIXTEENTH: The terms and conditions of ~his Agreement
, :
. shall be construed and shall be enforced according to the laws
of the State of Florida.
SEVENTEENTH: Thi's Agreement shall be and continue to be
binding upon the parties hereto, their respective heirs, '
executors, administrators and assigns, irrespective of the
death of the husband or of wnether the marriage between the
parties hereto continues or is dissolved~by a judgment for disso=
Iution of marriage. ;
