ARTICLE I - DEFINITIONS
, SECTION 1. The following words when used in this Decla~ation or any
Supplementary Decla~ation (unless the context shali prohibtt) shall have the
foliowing meanings:
(a) "Association" shall mean and refer to WINDMIIL POINT 11
PROPERTY OWNERS' ASSOCIATION, INC.
(b) "The Properties" shall mean and refer to a11 such existing
properties, and additions thereto, as are subject to this Declaration or any
Supplemental Declaration underthe provisions of Article II hereof.

(C) "Common Properties" shall mean and refe~ to those areas of
land shown on any ~ecorded subdivision plat of The Properties, as more fully
desc~ibed in Article II, Section 2 hereof~and on Schedule "B" attached hereto.
. (d) "Lot" shall mean and refer to any plot of land shawn upon any
recorded subdivision map of The Properties with the exception of Conmon Properties ~
as heretofore defined. ~

(e) "Living Unit" sha11 mean and refer to any portion of a building

situated upon The Properties designed and intended for use and occupancy as a t
~
residence by a single family. . ~
(f) "Owner" shall mean and refer'to tf~e record owner, wheti~er one s
or more persons or entities, of the fee simpie titie to any lot or Living Unit,
but notwithstanding any applicable theory concerning a mortgage encumbering any
Lot or Living Unit, shall not mean or refer to the mortgage unless arid until such
mortgagee has acquired title pursuant to_foreclosure or any proceeding in lieu ~

(g) "Member shall mean and ~efer to all those t~,rners who are members ;

of the Association as provided in Article III, Section 1, hereof.
