SECTION 2. COMMON PROPERTIES. That the property desc~ibed in
Schedule "B" attached hereto as it appears on the REPLAT OF PORT ST. LUCIE
SECTION FORTY-TWO, a Subdivision 1~ St. Lucie County, Florida according to
the plat thereof to be recorded in Plat Book 1 O at Page 1 8 of
the Public Records of St. lucie County, Florida be referred to as "Common ~
Properties" be dedicated as recreational and/or park areas and that the use

, of said co~mion properties be restricted and devoted to the cam~on use and en- ;

joyment of the owners of "The Properties" as herein defined.
SECTION 3. ADDITIONS TO EXISTING PROPERTY. Additional land may become ;
subject to this Declaration in the following manner:
(a) Additions. Upon approval in writing of the Association
pursuant to a vote of its members as provided in its Art~cles of Incorporation,
the owner of any property who desires to add it to the.scheme of this Declara-
tion and to subject it to the jurisdiction of the Association may file or record
a Supplementary Declaration of Covenants and Restrictions. . '

(b) Mergers. Upon a merger or consolidation of the Association with ~

another association as rovided in its Articles of Incor

rights and obligations may, by opera.tion of law be transferred to another sur-

viving or consolidated association, or, alternatively, the properties, rights r

i and obiigations of another association may, by operation of law, be added .to .

the properties, rights and obligations of the Association as a surviving corpora-.

~ tion pursuant to a merger. The surviving or consolidated association may
administer the covenants and restrictions established by this Declaration within i

the Existing Property except as hereinafter provided.

ARTICLE 111 - MEMBERSHIP ;
AND VOTING RIGHTS IN THE ASSOCIATION

~ SECTION 1. MEMBERSHIP. Every person or entity who is a record owner
~ of a fee or undivided fee interest in any Lot or living Unit which is subject

~ by these covenants of record to assessment by the Association shall be a membe r

of the Association, provided that any such person or entity who holds such
~ ~
~ _ interest merely as a security for the performance of an obligation shall not be ~

SECTION 2. VOTING R16HTS. The Association shall have two classes of ~
