Said plans as submitted shali show in detail and to scale the proposed eievation and locatlor~s of said trees, bushes. shrubs or plants, inciuding the location of same in relation to all other lots subject to these restrictions. (d) Committee Approval. Approval of said plans by the Enviror~mental Control Committee may be withheld if in the opinton of the Comnittee the view of any lot would be impeded by the location of such tree, bush, shrub or plant, or in any other manner. In any event, the Committee shall have the right to re- quire any member to remove, trim, top, or prune any tree, or~shrub, which in the reasonable belief of the Conmittee impedes or detracts from the view of any lot. SECTION 3. VARIANCES. The Board of Directors of the Association or the Environmental Control Cortmittee appointed by the Board may, with the approval of the City of Port St. Lucie and/or St. Lucie County Building and 2oning 6oard, approve variances to the requirements of Article IX, Sectian 2. SECTION 4. ATTORNEYS' FEES. In all litigation involving architectural or environmental con~rol, the prevailing party shall be entitied to coliect and shall be awarded attorneys' fees and court costs. ARTICLE VII - EXTERIOR MAINTENANCE SECTION 1. EXTERIOR MAINTENANCE. Pursuant to agreement with owner, or upon determination by the Association that an owner has failed to maintain the exterior of his Living Unit i~ accordance with generaistandards of the cor~unity, then, after reasonable notice to the owner specifying such failure and upon owner's neglect or refusal to correct the same, then, in such event, and in addition to maintenance upon the Comi~bn Properties, the Association may provide exterior maintenance upon each sucF? Living Unit as follows: paint, repa+r, replacement and care of roofs, gutters, downspouts, exterior building surfaces, trees, shrubs, grass, walks, and other exterior improvements. The cost thereof shall be assessed to the owner and shall be added to and become part of the maintenance assessment as more particutarly described in ~ Section 2 hereof. SECTION 2, ASSESSMENT OF COST.
