HomeMy WebLinkAbout0851 and to reach the su~~ect parcels within one month; that to date all clearing of right of way has been completed and 65~ of road- way construction has been completed; that the sub~ect parcels form a relatively small portion of the route of the transmission line to be constructed by Petitioner. It further appears that the Notices of Interlocutory Appeal herein were dated on June 17, 1978 and filed on June 19, 19?8, one month after entry of the Order of Taking herein, and that the Yotions for~Stay of Proceed- ings were not filed 6erein until July 18, 19?8, some~two months after the entry of the Order of Taking herein. It further appears that neither ~urisdiction or venue are seriously questioned ~ by said interlocutory appeals and that the primary thrust of said appeals is the question of necessity for the taking by Petitioner. After taking all relevant factors into consideration and being fully advised in the premises~ it is ~ ORDTRED AND ADJUDGED that said Defendants' Motions for Stay of Proceedings be and the same are each hereby denied.
