Defendant's Motion to Disr.iiss, and the Court having considered
said Motion, and having heard the argument of counsel,
and being otherwise fully advised in the premises, it is
hereby
ORDERED AND ADJUDGED that:
(a) The Motion to Dismiss as to Count 2 of the
Amended Complaint is hereby granted.
(b) The ~iotion to Strike is granted, in that the
Court finds that the matters relating to punitive damages and
~ any settlement negotiations or attempts to settle are not
~ proper matters to be alleged in this cause.
~ (cl The Plaintiffs shall have twenty (20) days from

~ the date of this Order in which to file an Amended pleading.
