HomeMy WebLinkAbout0867 prior to entry of a judgment enforcing this Mortgage if: (a) Borrower pays Lender all sums which would be thtn due under this Mortgage, the Note and nota securing Future Advances, i[ any, had no acceleration cecurred; Ib) Bor~ower cures all breaches ot any othe~ covenants br agreements ot Borrower contained in this Mortgage: (c) Bornower pays all reasonable expertses incu~red by Lender in enforcing the covena~ts and agreements of Borrower conuin~d in this Mortgage and in enforcing I.ender's rcmedia as provided in paragraph 18 Aereof, including. but not limited to, reasonable attorney's fees: and (d) Bo~rower takes such action as Lender may reasonably rcquirc to assure that the lien of this Mortgage. Lende~'s iqtercst in the Property and Bo~rower's obligation to pay the sums secured by this Mortgage shall oontinue unimpaircd. Upon such payment and curc by Borrower~ this Mongage and the obligations sccured he~eby shall rcmain in full force and effect as if no accekration had occurrcd. • 20. Assi6nmeat ot Reaf~ Appointmeot ot Receivcr. As additional security hercunder, Borrower hereby assigns to l.ende~ the rents of the Property, provided that Borrower shall, prior to acceleration under paragraph 18 hereof or abandon- ment of the Property, have the right to collect and rctain such rents as they become due and payable. Upon acceleration under parag~aph 18 heroof or abandonment of the Property, Lender shall be entitled to have a receiver appointed by a court to enter upon, take possession of and manage the Property and to collect the rents of the Propeny, including those past due. All rents collecteci by the receiver shall be applied Bnt to payment of the costs of management of the Property and collection of rents, including, but not limited to, roceiver's fees, prcmiums on rcceiver's boncls and reasonabk attorney's fees, and ther? to the sums securcd by this Mortgage. The rcceiver shall be liable to account only tor those rents actually received. 21. F~tyre Advaeces. Upon rcquest by Borrower, Lcnder, at l_ender s option wi~hin twenty years from the date of this Mortgage, may make Future Advances to Borrower. Such Future Advances, with intercst thereon, shall be securcd by this Mortgage when evidenced by promissory notes stating that said notes are secured hereby. At no time shall the principal amount of the indebtedness secured by this Mortgage, not including sums advanced in accordance herewith to protect the securiry of this Mortgage, excced the original amount of the Note plus USS .
