HomeMy WebLinkAbout0108 ~ . , $1,878.29 PROMISSORY NOTE Stuart, Florida . • August 1978 FOR VALUE RECEIVED, the undersigned, jointly and severally, PRO~ISE TO PAY to the order of McROBERTS, ~~ARNER & FOX, CHARTERED the sum of ONE THOUSAND EIGHT HUNDRED SEVENTY EIGHT &~29/100 DOLLARS, at 301 E. Ocean Blvd., Stuart, Florida, or such other place as the holder hereof may designate in writing, together with interest from date at the rate of eight & 1/2 (8.5~) per centper annum on the unpaid balance until maturity. The said principal and interest shall be due and payable as follows: In monthly installments of $100.00 each, commencing on the a°~ day of September, 1978, and continuing on the ~ a day of each succeeding month thereafter until the entire indebtedness has been paid. The installments of interest and principal shall be applied first to the interest on this note, and the balance shall be applied in reduction of principal. The right of prepayment in full or in part at any time, without penalty, is expressly reserved by the Undersigned. If any payment of principal or interest hereby required is overdue for more than thirty (30) days, the holder of this Note may, at holder's sole option, and without notice, ~eclare the entire balance~of principal then remaining unpaid to be immedia~el~ due and payable, and any failure to exercise said option shall ~ not constitute a waiver of the right to exercise the same at any other time. It is expressly~agreed that the principal su.rt of this Note shall become due, at the sole option of the holder, on the happening of any default or event by which, under the terms of the mortgage securing this Note, said principal may or shall become due and.payable, and that all of the covenants, conditions, and agreements contained in said mortgage are ! hereby incorporated by reference. Upon default in making any payment I hereby required, the undersigned promise to pay all costs, expenses, and i attorn~y fees, which shall include costs, expenses and attorney's fees, on appeal. ~ ' Upon maturity, or upon the exercise of the acceleration of maturity by ~ the holder of this Note, both principal and accrued interest shall bear ~ interest at the highest legal maximum ~rate. ~ s Presentment for payment, notice of dishonor, protest and notice of pro- ' test are hereby waived by the Undersigned, and any and all others who ~ may at any time become liable for the payment of all or any part of this ~ obligation. r This Note is secured by a Mortgage in fa~or of the holder on rEal estate ~ located in St. Lucie County, Florida.
