AMENDMENT TO FRUIT PARTCIPATION AGREEMENT ~

("Buyer" ) • ,
In and for the consideration of Buyer loaninq Grower _
the~sum of $125,000.00 and other good and valuable considerations, _
Buyer and Grower hereby agree to amend that certain Fruit Partici- ~
pation Agreement Number K-412-9, dated November 4,-1977, and re- ;
corded on April 26, 1978, in the Public Records of St. Lucie ~
County, Florida, in O.R. 285, Page 2267, by the addition of the -
following paragraph:
Notwithstanding any other provision within
this Agreement Number K-412-9, Grower may not terminate
this Agreement prior to the repayment of all sums owed ~
by Grower to Buyer. It is the intent of the parties
; hereto that this Agreement shall remain in full force =
! and effect without termination until such time as
i Grower has repai d all sums owing to Buyer from Grower. ;
