(hereinafter called the Grower). and TROPICANA PAODUCTS. INC. OF BRADENTON. FLOAIDA, Buyer
WITNESSETHt~
That the Grower. for and in conaideration oi the payments received and to be received. as hereinafter recited. has
agreed and does hereby a~ee to aell to the Buyer all citrus fruit of good wholesome. merchantable and raarketable
Quality irom the grove or grovp hereinaiter mentioned. The price to be paid and the iruit to be purchased. all oi which
truit is to be oi good wholesoine, merchantable and marketable quality. is as follows:
All PINBAPPLS and VALSNCIA ORANGSS (Bxcept Late Bloom) of the 1978-1979 season.
@ Tropicana Products, Inc. Daily I~larket Price at time of delivery, Tropicana Products,
Inc. Daily ~Iarket Price to be no less than .80~ per pound of solids delivered.
Alt iruit contracted to he purchased ahall, bc picked as and when Buyer is t'~ady. the picking to be completed on or
befose - seasonal „ 19Z2_, provided the Buyer shall not be hampered or prevented irom picking_
or shipping the same within said period by Act of God, strikes, railraad or other embargoes, quarantine or any other
condition, m~tter or thing, beyond its rnntrol, in which case the time for gathering and shipping said fruit shall ~e ex-
tended a length of time equal to the period of the hampering or prevention caused as atoresaid.
Wilhout limiting meaning oi "good wholesome, merchantable and marketable" it is aRreed thn• u? event ot substantial
damage by weather~ such .as irost or ireezing, wind. drought~ hail etc. the Buyer may elect to abandon this rnntract which
shall be done by registered mail mailed not later than fourteen days after the termination uf the weather condition
which caused the damage. sent to address given below whereupon Huqer shall be entitled to immediate refund of advance
payment lesa price of any fruit picked for which settlement has not been made. In such case Buyer may elect to take
such hvit as he shall consider useable, provided Bt~yer pays for it in accordance with. the tertns of this contract.

The Huyer has this day advanced to the Gmwer the sum of the receipt oi
which is hereby acknowledged bq the Grower. which sum is in advanc~ and part payment for said fruit at the price above
stated. Should the Buyer. in breach of this agreement, refuse to take this inut, the amount temaining on deposit with the
Grower shall be forieited to ihe Grower and shall be the sole damage hereunder.
Ii the value of the good wholesome, merchantable and marketable iruit available has not equalled the aanount paid
by the B~?er at the conclusion of the season provided for hereiu. the overage immediately will be returned by the
Grower to the Buyer.
Seller warrants good title to said inut with lawful rip,ht W enter into thia contract and warrants that it will be free
of all liens and claims. The individuals signing this agreement on behali of Gmwer represent that they have authority
to do so. Fruit is on grove or groves identiiied as: ~

; The DR. D. S. GOUDA GROVES, one grove located on Snead Road approximately three miles
~ south of U.5. 68, and the other grove located on Hidway Road approximately one mile east
of Shinn Road, both being in St. Lucie County.
