III:8 The Employer shall forthwith upon the execution here- ~
of, and on the first ~f the calendar montt~ next pre-
ceding each anniversary date, r?ake avail3ble to the
Committee a list of its employees and within ten (10)
days aEter receiot thereof, the Committee shalt notify
the Employer af the e~n~loyees of the ~;mpl~yer who are
eligible to become Participants in this Plan and
Trust, and shall notiEy each eligible employee and
forward him an application for participati~n.
III:9 Upon the request of a_Plan Participant or Deneficisry,
the Committee shall furnish on the basis of the latest
available information the total beneEits accrued and
the non-forfeitable pension benefit rights, if any,
which have accrued for such Plan Participant or Bene-
ficiary. No more than one request may be nade by any
. Participant or 8eneficiary for tfiis information during
- any one 12 month period. Any other reporting and
disclosure requirements of any government statute or :
regulation shall be completed by the Committee.
III:10 As it i~ re~lized that it is not possible to antici- • '
pate by this Agreement all questions which may arise
~ in the administration of this Plan, the Committee
shall carry out the intent and purpose of this Plan
in accordance with the authority.vested in_it, and in
the manner, set Eorth in Section III:3 of this Article
III.
III:11 The Pension Committec shall pravide adequate notice
in writiny to ~~ny participant or Beneficiacy whose
claim for benefits under the Plan has been denied,
setting fortl~ the specific reason for such denial
with speciEic references to pertinent plan provi-
sions, written in manner calculated tn be under-
stood by the ParticE~ant or Beneficiery., The Pension
Committee shall afford a reasonable opportunity to
any Participant whose claim for benefits has been
denied for a full anc~ fair review by the Pension
Committee of the decision denying the cl~im. A par-
ticipant shall be given (6.0) days in which to request
' a review of his claim and a decision shall be•ren-
dered within 120 days after the request for review. "
