'1'he ~'ension Conmittee shall deternine thc exi~-
tence or not of permanent incapacity ar~d its find-
~ ings, if supported by the written opinion of a
- qualified physician,~shall be conclusive ior all
purposes of this Agreement; except that, in its
disccetion, it may at any subsequent time or times .
review.any forner action it has taken With ~egard
to the permanent incapacity-of any Participant.
The date on which the first payment of such an-
nuity shall be come due and the form of such an-
nuity shall be detecmined by the Pension Committee
acting in the best interest of sucb incapacitated
Participant.
XI:6 The facts concerning the tecmination of a P3rti-
cipant's employment shall be transnitte.~ to the
Committee~of thp Flan and to the Trustee of the
Trust by written statement from the 6mployer, and ~
the Committee and the Trustee may accept such
i stater~ent as true and neither the Conmittee nor .
~ the Trustee shall incur any liability by reason of
~ ~ any action taken or omitted on the strength of
such statement.

XI:7 In the event the value of the vested retirenent
annuity accrued to date of a terminated Parti-
~ c ipant is ~ 1, 75U or -less the Commi ttee may d irect
~ the Trustee to mak~ such payment in full.

~ XI:B In no event shall a Participant be divested of any
~ accrued and vested benefit due to his discharge
~ foc cause, nor because of a Plan amendment resulting
in a lesser benefit or a les~,c vesting schedule.

ARTICLC XII
~ - KE-tMPGOYHENT

~ XII:1 A focmer Participant, whose employment has been
~ terminated and who shall be re-employed by the ~
g Employer, shall be considered as a new enployee
~ and shall.again become eligible for ~:articipation
~ when he shall have met the eligibility require-
ments of the Plan in connection with the period of
~ his re-employment. The benefits for such former
~ Participant shall, however, be adjusted to reflect.
~ ~ any Termination of Employment benefits which such
Particfpant received or became entitled to by
~ reason of any previous participation in the Plan
and Trust.
