This cause came on to be heard upon the Respondent. Wife's motion to dismiss, and upon the argument of counsel~and the Court being otherwise fully advised in the premises, the Court makes the following findings: 1. That Count II of the petition which is a petition for partition is deficient for the sole reason that it does not adequately - describe the household furnishings which are sought to be partitioned in the action. 2. ~ That in all other respects, the petition for partition is sufficiently pled. Upon the above findings-it is: ' ORDERED AND ADNDGED a. That the Wife's Motion to Dismiss, Count II is granted; = b. That the Husband shall have ten days in which to amend Y . i its petition for partition to adequately describe the household ~ . a ; furnishings sought to be partitioned; a ~ c.
