and evidence presented; it is hereby -
ORDERED AND ADJUDGED as follows:
1. Defendants' Motion to Dismiss Count I of the Complaint
is hereby denied.
2. Defendants' Motion to Dismiss Count II of the Complaint
; is moot in that the Plaintiff has taken a voluntary dismissal

~ 3. Defendants shall have twenty (20) days from the date
