WHEREAS, the parties hereto did agree that the

loan evidenced by the said note dated June 28, 1977, shall ;
be secured by a zeal estate mortgaqe encumberinq certain lands ~
~
held in fee simple by BUNING, and further encumberinq certain ~
i
lands held in fee simple by GUARANTORS, and provided, further, ;
that any rents which may be received from the lands encumber- ~
s
ed by said real estate mortgage be conditionally assigned to ~
t
MORTGAGEE as additional security for said loan; and
WHEREAS, the parties as stated hereinabove did
enter into said "MODIFICATION AND EXTENSION AGREEMENT AND
MORTGAGE" encumbering those lands more particularly described
and identified therein, and said agreement being recorded `
in the Public ~tecords of St. Lucie, ~ade, Hillsborouqh and
Broward County, Florida, as set forth hereinabove; and . ;

. WHEREAS, Paragraph IV of the said "MODIFICATION AND 1
~
EXTENSION AGREEMENT AND MORTGAGE" dated April 10, 1978,
provides for the pavment in full of the unpaid principal

balance due, together with all accrued interest due theres~n,
on September 20, I978; and
. WHEREAS, FLORISTS was unable to pay the principal
and ac.crued interest of the said note dated June 28, 1977,

and modified bv the said "MODIFICATION AND EXTENSION AGREEMENT }

AND MORTGAGE" dated April 10, 1978, on or before September ~

20, 1978, and is desirous of securing an extension of time ~
for payment; and ;

WHEREAS, the parties hereto have agreed to modify i

and extend the time for payment of the unnaid principal ~
~
balance due, together with all accrued interest due thereon, ~
which became due and payable in full on September 20, 1978; and ~

WHEREAS, the parties hereto wish to reduce all of }
their prior and contemporaneous understandings to writing;

NOW, THEREFORE, in consideration of the sum of TEN r_
AND NO/100 DOLLARS ($10.00) paid by each of the parties hereto
