4. The said Defendant shall have the right to file an
Affidavit on his behalf at the .time of the hearing shown in

the Plaintiff is entitled to the possession of the claimed
property pending the final adjudication of the claims of the
parties hereto, the Defendant shall have the right to file
with the Court a written undertaking executed by a Surety
approved by the Court in an amount equal to the value of the
property to stay any-Order issued by this Court authorizing
the delivery of the property to the_Plaintiff.
SHOULD THE DEFENDANT FAIL TO APPEAR AT THE HEARING OR
TO FILE AN AFFIDAVIT AS PROVIDED ABOVE, SAID DEFENDANT SHALL
BE DEEMED TO HAVE WAIVED HIS RIGHT TO A HEARING. AND IN
SUCH EVENT THIS COURT MAY ORDER THE CLERK OF THE COURT TO
ISSUE A WRIT OF REPLEVIN AS TO THE CLAIMED PROPERTY.
HEREIN FAIL NOT.
