HomeMy WebLinkAbout0607 ° ~ `O DECLARATION OF TRUST I, WILLIAM L. STARVES, SR., on this 21st day of December, F i 1978, do make the following Declaration of Trust: 1. I do on this date convey my undivided one-half interest as a.tenant in .common to my wife, MATTIE JANE STARVES, as { trustee, for my minor son, WILLIAM L. STARVES, JR., during his minority, in the real property described on EXHIBIT A attached t hereto, incorporated herein and made a part hereof: . 2. I do grant unto my said Trustee all of the powers granted to Trustees under Section 73 ~•~~j Florida Statutes (1977) and such future amendments to said statutes which expand said powers, not in conflict with the provisions of this Declaration Of Trust. 3. I do convenant and promise to pay one-half of the monthly mortgage payment currently existing on the property until such time as the mortgage is paid in full or the subject real pro- perty is sold, whichever first occurs, and I further covenant and ~ f promise to pay one-half of the real property taxes on said real property during the minority of my said son until he obtains his majority or until said real property is sold. 4. In the event that my-said trustee shall sell said real property she shall be entitled to deduct from the gross sale proceeds any monies paid by her out of her own funds for mortgage payments and taxes and one-half of the remaining monies shall be placed in a "Totten" Trust savings account or other such investment by her as Trustee for my minor son and I empower my Trustee to use said monies for the support of my minor son as she deems necessary, and I also empower my Trustee to reinvest the remaining monies in other real 1 estate so long as my Trustee is a record title holder as Trustee for my minor son of a porportion of the real property equal to the share of the trust monies paid for the purchase of said real propert .
