PIERGE, FLORIDA . - It appearing to the Court by the Petition of PAUL DeP00 that: l. Petitioner is the lawful owner of the boat known as the Sea Lady II, which was seized by the Defendant on oz about August 16, 1978, in Ft. Pierce, Florida. 2. Defendant is the Sheriff of St. Lucie Ccunty, Florida, in which Ft. Pierce is located, and is the Public Official who is in charge of the department which seized and is still in possession of ~ . ~ the Petitioner's boat, which was seized pursuant to Florida law in ~ connection with the seizure of a controlled substance, to wit: ~ ~ i marijuana. i ~ ; 3. It is the Defendant's duty, pursuant to Florida Statute ~ ~ 705.09, F.S.A., to have forthwith fixed the approximate value of the ~ ~ ~ boat and to have reported thereon to a Judge of the County Court, ~ ~ said report to comply with the provisions of the afore~aid Statute. ~ ~ 4. Petitioner, in~person and though his attorneys, de- ~ ~ manded of the Defendant that he either return the boat to the Peti- ~ ~ tioner or fully comply with applicable Florida law. 5. The Defendant refused to perform his duty by maintaining ~ his possession of the vessel while refusing to comply with the mandate ~ ~ of the above Statute.
