HomeMy WebLinkAbout1015 D. Enforcement of Provisions. The provisions hereof may be
enforced by 1 Association, any condominium association formed with respect to
and managing a condominium created by the submission of any portion of the
Future Development Property to the condominium form of ownership, the
owner of any Contributing Unit or any portion of the Total Equities Property
and any Institutional Mortgagee of record with respect to any portion of the
Section 1 Condominium or any portion of the Total Equities Property (including,
but not limited to, any Corttributing Unit thereon) in any judicial proceedings
seeking any remedy recognizable at law or in equity including , but not limited
to, damages, injunction or any other form of relief. The failure of any party
to enforce any provision hereof shall in no event be deemed a waiver of such ~
provision or the right of such party to thereafter enforce same or any other
provision hereof . The prevailing party in any such litigation shall be entitled
to reasonable attorneys' fees and court costs at all trial and appellate levels .
IN WITNESS WHEREOF, the parties hereto have executed this Agreement
