Such a designation(s) shall take place by an instrument(s) (the "Designation Notice(s)") being filed amongst the Public Records of St. Lucie County, Florida, designating all or a portion of the Excluded Property as a part of the "Future Development Property". Such Designation ~ Notices must be executed by High Point Equities, Inc., or its succes- sors or assigns and by the then (at the time the Designation Notice in - _ question is executed and recorded) record title holder of that portion ~ of the Excluded Property thereby being designated "Future Development ~ Property".
