be developed. Such Substitution shalt not, when installed, be higher than
three (3) feet above the ground level at the place of installation except that
vent pipes with respect thereto may extend six (6) feet above such ground
level and Equities shall cause same to be appropriately landscape screened .
Upon the Substitution, the items so replaced shall become the property of
Equities. The cost and expense of the Substitution shall be borne solely by
Equities. The Sewage System .Rights also include (but are not limited to) the .
right of the Future Development Property to be served by that portion of the
Section 1 Sewage System as is necessary to provide for sewage disposal from
the Future Development Property as same is hereinafter developed through
the force mains constituting a part of the Section 1 Sewage System. White 1
Association shall retain the obligation of maintenance of the Section 1 Sewage
System (including, but not limited to, the Section 1 ~ Lift Station) should 1
Association fail to so maintain the Section 1 Sewage System, Equities and its
successors and assigns and the owners of the Future Development Property or
any portion thereof or any association of any of them, shall have the right,
but not the obligation, to so maintain all portions of the Section 1 Sewage
System, the operation of which is necessary to provide such service to the
Future Development Property . Such easements over and across the property
constituting the Section 1 Condominium as may be necessary to provide such
maintenance are hereby granted by 1 Association on behalf of itself and all
Section 1 Unit Owners to Equities and its successors and assigns as the
owners of the Future Development Property which easements shall be appur-
tenant to and run with the Future Development Property and all portions
thereof . The owners of the Future Development Property being served by
the Future Development Property Force Main shall have the right and obliga-
tion to maintain same which right -and obligation shall run with and inure to
the benefit of and be binding upon the portions of the Future Development
Property being so served thereby.
5 . Use of , and Other Rights With Respect to, the Section 1 Condomin-
ium Water System. 1 Association, on behalf of itself and all Section 1 Unit
Owners, does hereby grant. unto Equities, and its successors and assigns as
the owners of the Future Development Property or any portion thereof , the
rights (the "Water System Rights") with respect to the Section 1 Condominium
water system (the "Section 1 Water System") set forth in this Paragraph
whfch. rights shall run with and be appurtenant to the Future Development
Property and alt portions thereof and inure to the benefit of Equities and its
j successors and assigns and the owners and occupants of any portion of the
! Future Development Property. The Water System Rights include (but are not
F limited to) the right to connect into the water main constituting a part. of the
Section 1 Water System at a point (as Equities shall determine) in the Entry
~ Way north of the property submitted to the condominium form of ownership as
set forth in Article I of the Section 1 Declaration (the "Connection Point").
At or near the Connection Point, Equities shall install a gate valve- and a
meter to meter the quantity of water utilized by the Future Development
1 Property which meter shall be no greater than eight inches in diameter. The
pipe connected to such meter to serve the Future Development Property shall
be no greater than eight inches in diameter. The Water System Rights also
include (but are not limited to) the right of the Future Development Property
to be served by that portion of the Section 1 Water System as is necessary to
provide water service to the Future Development Property . While 1 Associa-
tion shall retain the obligation of maintenance of the Section 1 Water System,
should 1 Association fail to so maintain the Section 1 Water System, Equities,
and its successors and assigns and the owners of the- Future Development
Property or any portion thereof or any association of any of them, shall have
the right, but not the obligation, to so maintain al! portions of the Section 1
Water System, the operation of which is necessary to provide such water
