T LESS AND EXCEPT that portion of the afore-described real property (the portion x of the afore-described real property now about to be excluded from the "Future Development Property" being hereinafter referred to as the "Excluded Property") which lies in Section 26, Township 35 South, Range~40 East to the East of the centerline of the following described parcel, to wit: The East 200.00 feet of the West 1320 feet of the Southwest 1/4 of the Southwest 1/4 of Section 26, Township 35 South, Range 40 East, said property lying and being situate in St. Lucie County, Florida. i t t NOTE: High Point Equities, Inc., or its successors or assigns, shall have the right to designate all or such portions of the Excluded Property as High Point Equities, Inc., or its successors or assigns, shall - determine as a part of the "Future Development Property Such a designation(s) shall take place by an instrument(s) (the "Designation M Notice(s)") being filed amongst the Public Records of St. Lucie - County, Florida, designating all or a portion of the Excluded Property as a part of the "Future Development Property". Such Designation Notices must be executed by High Point Equities, Inc., or its succes- sors or assigns and by the then (at the time the Designation Notice in question is executed and recorded) record title holder of that portion of the Excluded Property thereby being designated "Future Development Property At such time as all or any portion of the Excluded Property is designated "Future Development Property" under a Designation - Notice filed amongst the Public Records of St. Lucie County, Florida, such property so designated shall be deemed a part of the "Future Development Property under the instrument to which this Exhibit is attached and shall thereafter be subject to the burdens and entitled to the benefits of the Future Development Property under the said instrument to which this Exhibit is attached.
