p::~sses under this will or otherwise, including property over
which I have a power of appointment, without contribution by
any recipient of any such property.
ARTICLE III.
If I am survived by my sister,-Thelma Lovinggood Price,
then in that event I give and bequeath the sum of Five Thousand
Dollars ($5,000.00) to my brother, Dr. Thomas Allen Lovinggood,
and my attorney, Donn A. Southern, as joint. trustees for the
use and benefit of my said sister, Thelma Lovinggood Price,
during her lifetime. This trust shall be for the following
uses and purposes:
A. The Trustees shall hold, invest, and reinvest the ~
corpus of said estate, collect the income therefrom, pay the
expenses of administering the trust, and pay or apply the net
income to or for the benefit of the said beneficiary, Thelma
Lovinggood Price, for and during her lifetime. The joint
trustees shall have the sole judgment and discretion to pay the
said income directly to the beneficiary or to apply it for her
benefit, but in no event is the corpus to be used or encroached
upon for the benefit of the beneficiary. ~
B. At the death of my said sister, Thelma Lovinggood
Price, the trust shall terminate, and the amount held by the

joint trustees, whether corpus or unexpended income, shall be

r distributed in fee and free of trust to my wife, Josephine
Melhorn Lovinggood, provided only that she is then surviving.
In the event that my said wife shall not survive my sister as
aforesaid, then in that event, the remaining corpus and income ~
after my sister's death shall go in fee and free of trust to my
brother, Thomas Allen Lovinggood, and his heirs.
C. No principal or income payable or to become payable
under the trust created by this will shall be subject to an
