C. To employ such aycnts and attorneys as they deem to be
reasonably necessary in managing and protecting the trust
estate or in caring for any or all of the beneficiaries thereof
and to pay therefor such compensation as they deems reasonable.,
D. To borrow money, to sell, exchange, pledge, hypothecate,
mortgage, lease, or otherwise dispose of any property, real,
personal, or mixed or property acquired in substitution thereof
or otherwise, for such consideration, cash or credit, and upon
such terms as the Trustees shall deem best, and any such transaction
may extend beyond the terms of this trust and be binding on all
persons, and no person shall be under any duty to see to the
proper application of any money or property delivered to them.
E. To pay, collect, contest, sue upon, defend, compromise,
or otherwise settle taxes and other debts or claims, whether
such debts or claims are made against or on behalf of the trust
estate, whenever they deem such action to be in the best interest
of the trust estate.
F. In addition to and not in limitation of the foregoing
powers and to the extent not inconsistent therewith and to the
extent applicable to trustees or testamentary trusts, the
~ powers contained in the provisions of Section 35-618 of Title
E
35 of Tennessee Code Annotated are hereby incorporated by
reference.
ARTICLE VI.
Without in any way 1 inviting or restricting the absolute
nature of the gifts herein made, it is anticipated by me that
my wife or brother, as the case may be, will make gifts .of
certain personal effects or furniture in accordance with wishes
that I may relate to them either orally or in writing. While
it is my desire that such gifts shall be made, this shall be
solely discretionary with my herein named beneficiaries, and
this provision is precatory only and not a limitation or restriction
thereon. _
