This action was heard on Plaintiff's Motion for Summary
Final Judgment. The Court finds:
j 1. That a default was entered by the Clerk of the
Circuit Court against the Defendant, DEVITT J. ADAI?IS and JAY M.
ADA1?iS, his wife, on December 14, 1978 for failure to serve any

paper on the Plaintiff or file any paper as required by law.
2. That the pleadings on file, together with the
Affidavit of Plaintiff's President, show that there is no
genuine issue as to any material fact and that the Plaintiff is

entitled to a judgment as a matter of law.
` It is therefore
ORDERED AND ADJUDGED that Plaintiff, AMERICAN BANK OF-

~t MARTIN COUNTY, recover from Defendant, DEVITT J. ADAMS and

t JAY M. ADAMS, his wife, the sum of $5,651.14 together with its
costs in the sum of $51.00 and reasonable attorney's fees in the
amount of $750.00, all for which let execution issue.
