WITNESSETH: Tlut for diverse good and valuable considerations, and also in consideration of the aggregate sum named in the promissory note of even date herewith hereinafter described and all future promissory rtotes which may be secured by this Mortgage. the said Mortgagor does hereby gent, bargain, sell, alien, remise, rnnvey and confirm unto the said Mortgagee, its wccessors and assigns, all the land of which the said Mortgagor is now seized and possessed and in actual possession, situate in the County of S t . Lucie and State of Florida, described as follows: From the northwest corner of Government Lot 1, Section 33, Township 34 South, Range 40 East, St. Lucie County, Florida, run North 89° 53' East, along the north line of said Government Lot 1, 25.2 feet to the easterly right-of-way line of Florida East Coast Railway Co., thence south 20°43 east, along the easterly right-of-way line of Florida East Coast Railway Co., 303 feet to the Point of Beginning of the lands herein described, said point being at the intersection of the easterly right-of-way line of Florida East Coast Railway Co. and the westerly extension of an existing fence line extending east- erly-therefrom; from said Point of Beginning continue South 20°43' East, along the easterly right-of-way line of Florida East Coast Railway Co., 221.55 feet to .a railroad spike in existing paved road, the _ same being the southwest corner of the property owned.by Guardian Electric Manufacturing Co.; thence East, along the South line of said Guardian Electric Manufacturing Co. property 597.27 feet to a bolt ,J, in existing pavement; thence South 26 feet to a concrete monument; thence East, along the center of existing paved road,-235.3 feet to a point on the west shore of Indian River; thence meandering the west f shore of Indian River, run North 1°48' W est 248.8 feet; thence South 89°17' West along the line of an existing fence, 903.8 feet to the ` Point of Beginning. _ LESS AND EXCEPTING THE FOLLOWING DESCRIBED PARCELS: PA_rCEL 1. From the Northwest corner of Government Lot 1, Section 33, -Towns p 34 South, Range 40 East, St. Lucie County, Florida, run North 89°53' East along the North line of said Government Lot 1, 24.2 feet LEGAL CONTINUED ON ATTACKED SHEET easements and appurtenances thereunto belonging, or in any- wise appertaining, and the rents, issues, and profits thereof, and also all the estate, right, title, interest and all claims and demands _ whatsoever, as well in law as in equity, of said Mortgagor in and to the same, and every pert and parcel thereof, and also specif- tally but not by way of limitation, aU gas and electric fixtures, radiators, heaters, water pumps, air conditioning equipment, machinery, boilers, ranges, elevator and moron, bath tubs, sinks, water closets, water basins, pipes, faucets, and other plumbing and heating fixtures, mantels, refrigerating plants and ice boxes, window screens, screen doors, fluor covering, carpeting, tik,and drapery fixtures, venetian btirsds, cornices, storm shutters and awnings, which are now or may hereafter pertain to be used with, in or on said premises, even though they be detached or detachable, are and shall be deemed to be fixtures and accessories to the freehold and a part of the realty; and also such personal property as may be specifically described above of listed hereafter on attached exhibits. The lien or security interest in and to all sudr fixtures and accessories is hereby created and perfected by this mortgage deed. r TO HAVE AND TO HOLD the same, together with all and singular the tenements, hereditaments and appurtenances there- • unto belonging or in anywise appertaining and the reversion and reversions, remainder and remainders, rents, issues and profits i thereof and also all the estate, right, title, interest, property, entry, possession, claim and demand whatsoever as well in laws as in equity of the said Mortgagor in and to the same and every part and parcel thereof unto the said Mortgagee, and its representatives, ~l successors and assigns, in fee simple. j Mort ~ ~ Mortgagor, for himself, and his heirs, legal representatives, successors and assigns, hereby convenants that said gagee, its leg?1 representatives, wccessors and assigns may at aU times peaceably and quietly enter upon, hold, occupy and y enjoy said land and every part thereof; that said land is free from all incumbrances; that said Mortgagor, his heirs, legal repre- r- sentatives, successors and assigns, will make such further assurances to perfect the fee simple title to said land in said Mortgagee, its legal representatives, successors and assigns, as may reasonably be required; and that said Mortgagor does hereby fully warrant the title to said land and every part thereof and will defend the same against the lawful claims of.all persons whomsoever. r Provided always, the conditions of this mortgage are such that if the Mortgagor shall well and truly pay unto the Mortgagee the indebtedness evidenced by that certain promissory note of even date herewith, made by the Mortgagor and payable to the _ Mortgagee of which the attached specimen in words and figures is a true copy to-wit: Copy attached hereto - This instrument prepared by and to be returned to: (State of Florida documentary stamps in the amount required by law, if any, are affixed lac Spencer B .
