MOTION FOR LEAVE TO TAKE DEPOSITION BY VIDEOTAPE
THIS CAUSE came on to be heard upon the Plaintiffs' Motion
for Leave to Take Deposition by Videotape and the Court having
heard argument of counsel and being otherwise fully advised in
the premises, upon consideration, it is thereupon,
ORDERED AND ADJUDGED that the Plaintiffs Motion be and the
same is hereby granted.
ORDERED AND ADJUDGED that with respect to the videotape
_ deposition, all objections as to form shall. be preserved pending
a ruling by this Honorable Court in a hearing to be set by the
objecting party no later than ten (10) days prior to the date
j set for trial herein.
ORDERED AND ADJUDGED that with respect to any objection,
~ if the objecting party fails to set a hearing upon its objection
e
before a reasonale time prior to trial, the party's objection
shall be waived and the custodian of the videotape shall be
authorized to electronically edit the videotape to remove the
objections from the videotape. Further, if there is any editing
~ to be done, it is ORDERED that an original unedited tape be
a
~ ~ preserved and filed with the Court File in this matter. Further,
with regard to the videotape, it is ORDERED that a stenographic
transcription be made and the original of the transcript shall
be filed in the Court File.
