IN RE: DEREK ALAN LUKE, a minor.
ORDER AWARDING TEMPORARY CUSTODY AND RESTRAINING ORDER
THIS CAUSE, having come before the Court on the Petition of
Mary Ellen Gaetz for tempory child custody and a restraining order
pendente lite, ex parte, and the Court having considered the verified
petition and taken testimony of Mary Ellen Gaetz, it is
.ORDERED AND ADJUDGED that custody of the subject child, DERRICK
ALAN LUKE shall be and it is hereby awarded to Mary Ellen Gaetz until
Final Hearing in this cause; it is further
ORDERED AND ADJUDGED that Benjamin Franklin Luke shall and he
is hereby ordered to surrender custod_- and return DERRICK ALAN LUKE,
date of birth December 26, 1977, to Mary Ellen Gaetz forthwith; it is
further
ORDERED AND ADJUDGED that Benjamin Franklin Luke shall and he is
hereby ordered to refrain from intimidating, harassing, threatening
or otherwise annoying or injuring the Petitioner, Mary E11en.Gaetz or
the minor child, DERRICK ALAN LUKE; it is further

ORDERED AND ADJLDGED that C. L. Norwell, Sheriff of St. Lucie
County, and any of his authorized deputies, shall, and he is hereby

ordered to enforce this order without further direction of this Court;

~ ORDERED AND ADJUDGED that this order shall be served upon
Benjamin Franklin Luke with the Petition for child custody in this
matter.
DONE AND ORDERED this l2- day of January, 1979, at fort Pierce,
St. Lucie County, Florida.
