MORTGAGE
THIS MORTGAGE made as of the 17th day of January,
1979, by HERMAN A. HEISE, residing at 1395-34th Ave. Vero
Beach, Fla. 32960 ("Mortgagor") to AMBERSON ENTERPRISES, INC.,
a New York corporation having an office at 1414 Avenue of the
Americas, New York, New York 10019 ("Mortgagee")..
WHEREAS, Mortgagor is justly indebted to Mortgagee,
in the sum of One Hundred Thousand ($100,000) Dollars (the
"Debt"), lawful money of the United States of America, to be
paid according to Mortgagor's note bearing even date hereof
and Mortgagor, for better securing the payment of the said
sum of money mentioned in the condition of the note, with
interest thereon, and the performance by Mortgagor of the
terms, covenants and conditions herein contained, and also for
and iri consideration of the sum of one dollar to Mortgagor in
hand paid by the said Mortgagee, the receipt whereof is hereby
acknowledged, does mortgage, grant, bargain, sell, alien, re-
lease, convey. and confirm unto- the Mortgagee, forever,
All of Mortgagor's right, title and interest in and
to the land described in Schedule A hereto (the "Premises") and

(the "Improvements");

Mortgagor in and to the following property, rights and inter-
± ests which Mortgagor hereby assigns to Mortgagee until the
Debt is paid (the Premises and the Improvements together with

~ lectively referred to as the "Mortgaged Property"):

(i) all easements, licenses and appurtenances

~ (ii) all machinery, apparatus, equipment,
F fittings, fixtures and articles of personal pro-
' perty of every kind and nature whatsoever other
than consumable goods now owned by Mortgagor or
hereafter acquired in substitution for or re-
placement thereof, or in which Mortgagor has
or shall have an interest, now or hereafter
~ located upon the Premises, or appurtenances
thereto, and usable in connection with the.
Improvements (the "Equipment").
~ (iii) all awards or payments, including
interest thereon, which may be made with respect
to the Premises and Improvements, whether from
the exercise of the right of eminent domain
(including any transfer made in lieu of the
~p exercise of said right), the alteration of the
~ grade of any street, or for any other injury to
or decrease in the value of the Premises and
Improvements;
