HomeMy WebLinkAbout2318 (iv) all proceeds of and any unearned pre- miums on any insurance policies covering the Mortg aged Property, including, without limita- tion, the right to receive and apply the proceeds of any insurance, judgments, or settlements made in lieu thereof for damage to the Mortgaged Prop- . erty; (v) all citrus crops to be grown on the premises commencing with the crop emanating from the 1979 bloom and thereafter for the life of this mortgage and security agreement; provided, however, that upon the payment of each anniver- sary installment of principal and interest then accrued, the citrus crop then in being and emanating from the bloom of the preceding cal- endar year shall be released from the lien and operation hereof and Mortgagee will execute and deliver to Mortgagor such termination of financ- ing statement covering that citrus crop as may be then required. AND Mortgagor covenants with Mortgagee as follows: 1. Mortgagor will pay the Debt in accordance with the note secured hereby. 2. Intentionally Omitted. 3. The Equipment now or hereafter covered by the lien of this Mortgage shall not be removed, demolished or materially altered (except for normal replacement of the Equipment), without the prior written consent of Mortgagee. Mortgagor will maintain the Mortgaged Property in good condition and repair, will not commit or suffer any waste of the Mortgaged Property and will comply with, or cause to be complied with, all statutes, ordinances and requirements of any governmental authority relating to the Mortgaged Property. Mortgagor will promptly repair, restore, replace or rebuild any part of the Mortgaged Property now or hereafter - subject to the lien of this Mo rtgage which may be damaged or destroyed by any casualty whatsoever or which may be affected by any proceeding of the character referred to in Article 16. r Mortgagee shall maintain and care for the citrus trees and ~ crops located or grown on• the Mortgaged Property, such main- tenance and care to include cultivating, spraying, dusting, P pruning, fertilizing, irrigating and protecting the trees and crop against damage by freezing and fire, all to be done in a good and husbandlike manner and in accordance with standard 3 methods of citrus grove caretaking generally recognized, accepted and in use for citrus groves located in the Indian River area, Florida. Mortgagor shall not hedge or topwork the citrus trees located upon the Mortgaged Property without the prior consent of Mortgagee. Mortgagor will not without the prior consent of Mortgagee, such consent not to be - unreasonably withheld, initiate, join in, or consent to any - change in any private restrictive covenant, zoning ordinance, or other public or private restrictions, limiting or defininq_ the uses which may be made of the Mortgaged Property or any part thereof. • 2 ~o~~ 3U1 Q~~f ~3~3 z _ _
