BALIUS, JR., ESQUIRE, and CHERYL D. BALIUS, Wife. O R D E R THIS CAUSE coming on for hearing this 16th day of January, 1979, upon the Motion for Modification of Final Judgment filed by the Husband and the Amended Answer thereto, filed by the Wife, and the Court having heard argument of counsel and the testimony of the witnesses and the Court finding from said evidence that there is a failure to demonstrate a sufficient change of circumstances from the date of entry of the Final Judgment of Dissolution of Marriage awarding the Mother custody. of the three minor children, and the Court further finding that the Husband has failed to pay any support since the last Order of this Court and that said Husband does not come into this Court with clean hands, it is upon consideration ORDERED AND ADJUDGED as follows: , (1) That the Motion for Modification of Final Judgment as i to the change in custody of the two minor daughters, be and the same is hereby denied, and this Court does hereby require the Husband to return the two minor daughters to the actual custody of the Mother s at the end of the school year and further, reserves all reasonable F a rights of visitation to the Husband and allow said minor children t to visit with said Husband at all reasonable times and places. (2) That the Husband is in arrears on the child support payments required by this Court's Order dated October 18, 1978 and = has made no payments for a period of thirteen (13) weeks since the entry of said Order.
