It is hereby stipulated by and between the parties to this action as

follows: '
WHEREAS, plaintiff, W. R, GRACE & CO, , commenced an action
under the above caption to recover on an open account for goods sold and
delivered to defendants D. S. CASE and O. B. TAYLOR individually and
d /b /a SOUTHEASTERN TOMATO COMPANY; and
.WHEREAS, neither defendant has any defense to the claim a s set F

forth in the complaint; and
WHEREAS, in order to minimize the trouble and expense of litigating

the claim, defendants D, S, CASE and O. B. TAYLOR, jointly and severally,

wish to admit liability for the entire sum due and immediate entry of judgment;
NOW THEREFORE, .the parties hereby agree as follows:

entire amount claimed in the complaint in the amount of $48, 088, 3? principa 1,
plus interest and credit charges through November 25, 1978 of $11, 753. 01 for
a tota 1 indebtedness of $ 59, 841. 38,
