THIS CAUSE coming on to be heard upon the Respondent, Roy I.
Andersen's motion for appointment of a commissioner, and the parties
being represented by their respective counsel, and the court being ~
fully advised in the premises, it is.
ORDERED AND ADJUDGED that Respondent's motion is denied with-
out prejudice because of the fact that. an-appeal is pending, and that -
these parties held joint property for many years, and that it does not
i
appear that any undue hardship would bear upon either party in main-
taining tenancy .in common pending the outcome of the appeal; and

either party, upon motiom, may if appropriate, request the appointment
i
of a commissioner after the outcome of the appeal.
