Court to dismiss the above styled cause pursuant to Rule 1.420 (e)

of the F.R.C.P. and states: ~
1. Rule 1.420 (e) F.R.C.P. provides in part

"All actions in which it appears on the face
of the record that no activity by filing of pleading,
of court or otherwise has occurred for a period of ~
' one (1) year shall be disr?issed by the court on its p
own motion or on motion of any interested person. "
2. The last activity in this cause was the Notice of
Deposition filed by defendant's counsel on October 27, 1977 set-
ting a deposition date of December 12, 1977. ;
WHEREFORE, defendant prays that this Court dismiss
this action in the manner vrescribed by the Florida Rules of

Civil Procedure 1.420(e).
