THIS CAUSE was heard on the 15th day of January, 1979, upon the
Motion and Affidavit for Enforcement previously filed herein by the Petitioner,
and the Petitioner being present in open Court in person and represented by
counsel, and the Respondent having appeared in person in open Court and not having
been represented by an attorney, and the Court having heard all of the testimony of
the parties and being fully advised in the premises, it is therefore
ADJUDGED that IDWARD BURCH, the Respondent, had the financial ability '
to pay the sums hereinafter referred to and is now adjudged guilty of willful
contempt of this Court for his willful failure to pay support payments as directed
by order duly entered herein. It is
ORDERID AND ADJUDGID that commencing on January 19, 1979, the child
support payments as previously ordered herein shall ba and they are hereby increased
to $60.00 per week, plus $2.00-statutory fee, to be paid in the manner as set forth
in previous orders entered herein. It is further
ORDERID AND ADJUDGID that said payments of $60.00 per week shall continue
until the arrearage in the amount of $716.00 is paid in full. It is further
ORDERED AND ADJUDGID that if the Respondent, IDWARD BURCH, is not current
on his support 'payments of $60.00 per week-on March 1, 1979, he is hereby sentenced
to serve 30 days in the St. Lucie County Jail, Fort Pierce, Florida. It is further
ORDERED AND ADJUDGED that if the Respondent, IDWARD BURCH, defaults
on the payments of $60.00 per week at any time after March 1, 1979, the Petitioner
shall and it is hereby ordered to bring this matter before the Court for hearing
upon due notice to all parties concerned. It is further
ORDERID AND ADJUDGID that if the Respondent is in default on March 1,
1979, the Sheriff of St.~Lucie County and his duly authorized deputies are ordered
to arrest the said IDWARD BURCH on said date or as soon thereafter as he can be
found and deliver him to the Sheriff of St. Lucie County, Florida, for the execution
of the above described judgment and sentence. The Clerk of Circuit Court and this
Court shall be prorptly notified of his arrest. It is further
ORDERID that the Clerk of the Circuit Court shall and he is hereby
ordered to forward said arrearage payment received from the Respondent until the
~ _ above arrearage is paid in full to the Department of Health and Rehabilitative
~ Services, Child Support Enforcement Section, 1317 Winewood Boulevard, Tallahassee,
~ Florida, 32304.
