DEFINITIONS The following words and phrases when used in this Declaration (unless ; the context should clearly reflect another meaning) shall have the following meanings A. "Residence" means any residential dwelling unit now or hereafter constructed upon the real property submitted to the condominium form of ownership under the Section 1 Declaration or upon the Future Development Property whether consisting of, without limitation, detached single-family homes, attached townhouse dwellings, attached duplex or other multiplex dwellings or any apartment-type unit contained in any multi=unit, multi-story, residential building and whether any of the foregoing are subject to fee simple, cooperative; condomfnium, rental or other forms of ownership and possession. Unless a contrary intention is clearly stated or indicated, any reference~in this Declaration to a particular parcel of real property (e.g. , the '`'Future Development Property") shall include, but not be limited to, all Residences now or hereafter constructed thereon . B ` "Contributing Unit" shall mean each Residence which has been issued a Certificate of Occupancy by the appropriate governmental authority or is otherwise permitted to be occupied under applicable law. C. "Governmental Authorities" means, collectively, the City of -Fort Pierce (the "City"); St. Lucie County (the "County"); ,the State of Florida (the "State") ; and the United States of America (the "Federal Government") . D . "Governmental Purposes" means all activities of the Governmental Authorities in providing all governmental services including , but not limited to, police and fire protection; garbage collection; mail delivery; building inspectors; etc. E . "Owners" means the Owner or Owners of the fee simple title to any Residence now or hereafter located upon, or any portion of, the Future Development Property. II. DRAINAGE EASEMENT Equities hereby grants unto 1 Association and all Sectfon 1 Unit Owners and their respective successors and assigns , a nonexclusive easement to permit the drainage of surface waters from that portion of the Section 1 Condominium more particularly described on Exhibit C attached hereto and E made a part hereof under that portion of the Future Development Property. ~ more particularly described on Exhibit D attached hereto and made a part hereof and into that portion of the Future Development Property more particu- ~ laxly described on Exhibit D-1 attached hereto and made a part hereof . The ~ term of this easement shall be perpetual and shall be appurtenant to and run a with the portion of the Section 1 Property being served thereby. III.
