IT IS HEREBY STIPULATED by and between the parties to
this cause, plaintiff, GEORGIA-PACIFIC~ CORP., and de#endant, PETER C.
SMITH, as follows: ~
1.. The parties acknowledge that Final Judgment was duly
and properly entered in the action Georgia-Pacific Corp. v. Sires
Lumber Company, Edwin J. Wofford and Peter C. Smith, Court of Common
of South Carolina in and for the County of Charleston, Case No.
76-CP-10-248 in the amount of $31,520.90 plus costs in the amount
of $37.50 and interest. The sum of $5,000.00 has been paid on said
Final Judgment~ leaving the balance of $26,558.40 plus interest.
2. Defendant, PETER C. SMITH, was and is the guarantor of
the obligations of Sires Lumber Company as set forth in Count II of
the Amended Compl.aint "filed in this cause and a total of $26,558.40

i plus interest and the cost and plain~iff's attorneys' fees are due
~ in this action.

~ - 3. In settlement of this cause and in satisfaction of all

j amounts due the plaintiff, GEORGIA-PACIFIC CORP. by PETER C. SMITH,

~ defendant, PETER C. SMITH, agrees to pay to GEORGIA-PACIFZC CORP.:

6 . A. the principal amount of $26,558.40;

~ B. interest~of 6$ per annum on the principal amount

~ since November 23, 1976, in the amount of $3, 452. 59; and .

~ C. plaintiff's attorneys' fees in the amount of $1,650.00 -

and costs in the amount of $121.00. ' .
; 4. The total amount of $30,131.99 as set forth in paragraph

3 above shall be paid by PETER C. SMITH to GEORGIA-PACIFIC CORP. on
~ or before February 5, 1979, in the form of a cashier's check or a
