- THIS CAUSE having come on before the Court upon the
Motion for More Specific Statement of Defendants, CODY and CAROLYN
BAILEY, E.M. RADKE, JACKIE CAYNON, as Personal Representative of
Carrie Jahnson, Motion to Dismiss of R.E. SLAY, JR. and BETTY J. ~
SLAY and Motion to Strike said Motion.to Dismiss, and the Court
having considered the same, and hearing the arguments of counsel
. and agreements and stipulations pertaining to certain matters,
- it is hereby
ORDERED AND ADJUDGED as.~-follows:
(1) The Motion for More Definite Statement is granted

I by agreement with the Plaintiff required to file an Amendment to
~ Exhibit D to its Complaint within 10 days of the date hereof;

~ (2) The Motion to Strike Motion to Dismiss of Defendants

~ R.E. SLAY, JR. and BETTY J. SLAY is granted;

~ (3) The Motion to Dismiss of Defendants, R. E. SLAY, JR.
~ and BETTY J. SLAY is denied;

~ (4) Defendants, R. E. SLAY, JR., and BETTY J. SLAY,
~ shall have 20 days from the date hereof in which to file an Answer,

~ expressly granting them leave to raise the issues raised in their

Motion to Dismiss as affirmat~.ve defenses;

(5) Defendants, CODY BAILEY and CAROLYN BAILEY, E.M.

RADKE and JACKIE CAYNON, as Personal Representative of Carrie Johnson,
