O R D E R
THIS CAUS~ came on before the Court upon the Motion
to Strike Affirmative Defenses, Motion to,Strike certain portions
of the Counterclaim and Motion to Dismiss Counterclaim, all filed
by the Plaintiff, CITY OF FORT PIERCE, and the Court having
considered the same, hearing the arguments of counsel, and
being otherwise fully advised in the premises, it is hereby .
ORDERED AND ADJUDGED as foilows-: ~
(1) The Motion to Strike Affirmative Defenses is
denied, the Court finding the defenses of retaliatory eviction-
and constructive eviction to be affirmative defenses, and the
defense of tender to be limited to only certain claims, interest
and costs; ~

(2) The Motion to Dismiss the Counterclaim is•granted
i
~
with prejudice to the refiling of the same, the Court expressly
k finding that there be no-cause of action recognized for retaliatory
~
~ eviction;
~ (3) The Motion to Strike~certain portions of the Counter-
claim is moot and is not addressed.
