BEFORE ME, the undersigned authority personally appeared,
SAUL J. SACK, who being duly sworn, ~according to law, deposes and
says:
1. That I am Assistant Secretary and Corporate Counsel of
General Development Corporation, a Delaware Corporation, .
authorized to transact business in the State of Florida and which
has its principal place of business at 1111 South Bayshore Drive,
Miami, Florida 33131.. -
2. On December 12, 1968 General Development Corporation entered
into a contract with Michael and Margaret Radice for the sale of
Lot 18 of Block 135, of South Port St. Lucie sub-division, a sub-division
according to the Plat thereof, recorded in Plat 14, page 26 of the ~
.Public Records of St. Lucie County, Florida. A~copy of said contract
is~attached_hereto. Pursuant to said agreement, General Development
Corporation issued a Warranty Deed for said property to Michael and
i Margaret Radice on August 25, 1976. Said Warranty Deed is recorded

~ 3. On February 15, 1969 General Development Corporation entered ~

~ into a contract with Ivan Iler for the purchase and sale of Lot 19,

Block 135 of South Port St. Lucie sub-division, a sub-division
according to Plat Book 14, page 26 of the Pubiic Records of St. Lucie
~ County, Florida. A copy of said Agreement is attached hereto. On
~ May 1, 197.8 General Development Corporation issued a Warranty Deed to r
~ Ivan and.Aura Iler as joint tenants with a Right of Survivorship and
~ .
" not as Tenants in Common, to the aforementioned Lot 18 of Block 135, ~
~ ~
Unit 8, South Port St. Lucie sub-division. This deed contained a

~

~ scrivener's error that referred to Lot 18 rather than Lot 19 as called
~ for under the contract between General Development Corporation and
~ Ivan Iler. The deed is recorded in Official Records Book 290 at Page ~
~ ~
~ 2235 of the Public Records of St. Lucie County, Florida.
