Dear Mrs. Hubbard: ~ - ~ ~ Thank you for your letter of December 13, 1978, and the j letter which the association received from Attorney Norman D. Tripp. iJhen a condominium owner marries, it is not_necessary to ~rake the spouse apply for approval. The correc.t procedure ~ is simply to notify the Condominium Association that a change ' in record title owners has come about by virtue of marriage. ; There is a recent District Court of Appeals decision wherein ~ it was held to be improper for the Condominium Association ~ ! to screen people under this set of facts. The Court holding ~ ~ in .that case that it was tantamount to screening the applicant _ for marriage. I think the proper thing to do would be for ~ the Condominium Association to simply send the Attorney a : letter indicating that it is not necessary for them to apply ` for approval and that you will mark your records appropriately. ; 2 ~ Very truly yours, ~ . ~ ~ / f ~J f - .
