'First Parties furthe~^ agree to release fran the terms of the aforesaid mortgage
securing this obligation as modified herein, any and all portions of the property ;
hereinabire described in the event of construction and erection of any building
or buildings thereon, provided that payment is made to First Parties of an amount
proportionately equal to the principal balance of the obligation and the amount
of land being so requested for release to the whole tract of land mortgaged as i
herein described.
4. By entering into this Modification Agreement, First Parties are t
not in any manner waiving enforcement of the terms and effect of the obligation
originally made by the said Patrick Donnelly and June C. Donnelly, his wife,
against those makers.
5. The artier a ree that the aforesaid original obligation, as modified

herein, together with the mortgage securing it, shall be binding upon the heirs, ~
successors and assigns of each party hereto and shall be specifically assumable F
by any successors in interest to Second Parties without-approval of First Parties,
provided, however, that in the event of assumption from Second Parties, Second
Parties shall not be released from the terms and effect of these obligations.
6. All remaining provisions of the original Promissory Note and Mortgage
• securing repayment of it as set forth above, which are not inconsistent with the
terms of this Modification Agreement, are hereby ratified and confirmed and shall
remain in full force and effect. i
